Have you ever wondered what recourse you would have if you were to be hit by a car while riding your bicycle? Per Florida state law, every driver must have Personal Injury Protection (PIP) coverage on their insurance policies. Additionally, this coverage can provide for up to 80% of your medical bills (up to $10,000). If you don’t have PIP, the at-fault driver’s insurance may cover some of your costs. However, if the at-fault driver does not carry insurance, you can file a claim against your Uninsured Motorist Coverage, using either your insurance policy or the policy of a family member you live with.

Just like any other accident involving multiple cars, if you are struck by a vehicle while riding your bike, you are entitled to a replacement or repairs. Items such as bicycles are property, and insurance covers damage to property. If through investigation, it is found that the driver of the car was at fault, it is the responsibility of the at-fault driver’s insurance company to compensate you for any necessary repairs, or the full replacement of your bike. Make sure you document everything you can about the accident with quality pictures of the damaged property and the full scene of the crash. Also, include photos of any impediments that may have contributed to the accident.
